EU Digital Markets Act Two-Year Review Identifies Cloud and AI as Key Enforcement Gaps

The European Commission's first formal DMA review concluded the regulation remains fit for purpose but identified cloud computing and AI as critical future enforcement gaps. The EC has launched market investigations to determine whether AWS and Microsoft Azure should be designated as gatekeepers, and is examining whether AI assistants fall under existing DMA categories. Seven gatekeepers covering 23 core platform services have been designated to date, with seven non-compliance proceedings initiated.
Technical significance
The EC's explicit targeting of cloud services and AI as DMA enforcement priorities signals that major cloud providers may face gatekeeper designation within 12-18 months. If AWS and Azure are designated, they would be required to offer interoperability, data portability, and fair access provisions that could reshape the cloud market.
