EU AI Act Omnibus Delays High-Risk Obligations by 16 Months, Adds AI-Generated Intimate Imagery Ban

The EU Council and Parliament reached a provisional agreement on the AI Omnibus that postpones high-risk AI obligations from August 2026 to December 2027 (16 months) and Annex I products to August 2028. The deal compresses the generative AI watermarking grace period to 3 months and adds a new prohibition on AI-generated non-consensual intimate imagery including nudifier apps. The Machinery Regulation was moved from Annex I Section A to Section B, meaning AI Act requirements for machinery will be absorbed into sectoral procedures. The deal followed a failed trilogue on April 28 and a last-minute Franco-German intervention.
